In this paper the author analyses the risks posed by AI systems and the solutions already offered by the existing Data Protection Framework in the EU. In this regard, algorithmic risk-assessment tools are taken as case studies throughout the contribution. The analysis, although focused on Data Protection law, addresses the proposal for an AI act and takes into consideration the technicalities of AI systems. The paper concludes with some recommendations to be considered when implementing this new technology in our society, and especially in the public sector.
