The European Health Data Space represents an important advance in the context of the European Data Strategy, among other issues, in relation to the promotion of the rights of natural persons regarding the primary use of their health data, a matter in which it offers some novel solutions. The Proposal for a Regulation published in 2022, and currently in the process of being discussed, provides for a series of rights that, in practice, require a new configuration in the national medical records system of Member States such as Spain, which serves as a reference in this study.
